1. Agreement to Terms

By placing an order with Divine Delights Fine Desserts ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not place an order. We reserve the right to update these terms at any time.

2. Order Terms

• Minimum order: Orders may be subject to a minimum quantity or dollar amount. Current minimums are displayed during the ordering process.
• Lead time: All orders require a minimum of 72 hours advance notice. Custom or large event orders may require additional lead time. Please contact us for rush order availability.
• Order confirmation: Your order is not confirmed until you receive an order confirmation from us. We reserve the right to decline any order.
• Cancellation: Because brigadeiros are custom-made, perishable food products, cancellations follow a tiered refund schedule: cancellations more than 72 hours before fulfillment receive a 100% refund, 24–72 hours before fulfillment receive a 50% refund, and less than 24 hours before fulfillment (or after production has started) are not eligible for a refund. 3. Payment Terms

• All payments are processed securely through Stripe. We accept major credit cards and debit cards.
• Payment is required at the time of order unless otherwise agreed upon for large event orders.
• Refunds: Refunds are governed by our Refund & Cancellation Policy, which includes a tiered cancellation schedule, a 24-hour quality guarantee for damaged or spoiled shipments, and the dispute-handling process. Refunds are issued to the original payment method and typically appear within 5–7 business days.
• All prices are listed in US dollars and are subject to applicable Florida sales tax.

4. Delivery Terms

• Delivery zones: We currently deliver within the greater Orlando, FL metropolitan area. Delivery fees may vary based on distance.
• Delivery timing: Delivery windows will be communicated at the time of order confirmation. We make every effort to deliver within the agreed window but cannot guarantee exact delivery times due to traffic and weather conditions.
• Pickup: Pickup is available by appointment at our Orlando location.
• Perishable goods: Our products are perishable and should be refrigerated promptly upon receipt. We are not responsible for product quality after delivery if products are not stored properly. Please consume within the timeframe indicated on your order.

To the maximum extent permitted by Florida law, Divine Delights Fine Desserts shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your order or use of our products. Our total liability to you for any claim shall not exceed the amount you paid for the specific order giving rise to the claim.

All content on this website, including text, images, logos, and designs, is the property of Divine Delights Fine Desserts and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written consent.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, Florida.
