Refund & Cancellation Policy

Why a tiered refund policy?

Brigadeiros are a custom-made, perishable food product. Once production begins, the ingredients are purchased and the labor is committed. Once delivered or shipped, the product cannot be resold because federal and Florida food-safety rules prohibit the resale of perishable prepared food. This policy is designed to be fair to customers who cancel early while protecting us from the real costs of late cancellations.

1. Cancellation Tiers

The refund you are entitled to depends on how far in advance of your scheduled delivery, pickup, or ship date you request the cancellation. Cancellation time is measured from when we receive your written cancellation request (email or contact form) to the delivery / pickup / shipping time on your order confirmation.

2. How to Cancel

To request a cancellation, email us at hello@getdivinedelights.com with your order number (the 8-character code in your confirmation email) and a brief reason. We will reply within one business day to confirm the cancellation and the refund amount.

Please do not dispute the charge with your bank before contacting us — give us the chance to resolve it directly. Disputes filed without first contacting us and before the fulfillment date will be contested using the records of this policy and your checkout consent.

3. How Refunds Are Issued

  • Refunds are issued to the original payment method(credit/debit card via Stripe).
  • Once we process the refund, it typically appears in your account within 5–7 business days, depending on your card issuer.
  • We do not charge any processing fee on refunds; however, promotional discounts and credits applied to the original order are refunded proportionally.
  • For orders placed with a promo code, the refund is calculated on the net amount you actually paid — not the pre-discount subtotal.

4. Quality Guarantee

Despite the no-refund rule for post-delivery orders, we stand behind the quality of our brigadeiros. If your order arrives damaged, spoiled, or materially different from what you ordered, contact us within 24 hours of receipt with:

  • Your order number
  • A clear description of the problem
  • Photos of the affected product and packaging

We will review each case individually and offer, at our discretion, a replacement, partial refund, or store credit. This quality guarantee does not cover issues caused by the customer after delivery, such as improper storage, failure to refrigerate promptly, or consumption past the recommended window.

5. Shipping-Specific Terms

  • Shipping charges are non-refundable once a label has been generated — the carrier has already committed the resources. If you cancel before the label is generated, shipping is refunded in full along with the rest of the order.
  • Delivery exceptions (lost packages, carrier delays exceeding the estimated window, damage caused by the carrier) are handled on a case-by-case basis. We will work with you and the carrier to resolve the issue and will re-ship or refund at our discretion.
  • We are not responsible for orders that spoil because the customer was not available to receive the package during the delivery window and the package sat on a porch in hot weather. If you will not be home, please use a local pickup option or arrange for a neighbor.

6. Event and Large Orders

For catering and large event orders (generally $300 or more), a custom cancellation schedule may be agreed in writing at the time of booking. If no custom schedule is provided, the default tiered policy above applies. Event deposits, if taken, are non-refundable within the 72-hour window.

7. Your Agreement

By completing checkout, you confirm that you have read, understood, and agree to this Refund & Cancellation Policy and to our Terms of Service. A timestamped record of this consent is stored with your order and is the basis on which disputes are evaluated.

8. Governing Law & Changes

This policy is governed by the laws of the State of Florida and the Florida Deceptive and Unfair Trade Practices Act (FDUTPA). Any dispute is subject to the exclusive jurisdiction of the courts located in Orange County, Florida.

We may update this policy at any time. Changes apply only to orders placed after the update. The version in effect at the time you placed your order is the one that governs your order.
